Analysis of the Legal Effects of Suspension of a Lawyer on Pending Cases

Abstract
Introduction and Objective: This research aims to analyze the legal effects of suspending a lawyer in pending cases, as well as to examine protective measures for clients and the conditions for the reinstatement of a suspended lawyer to the legal profession.
Research Methodology: The present research was conducted using a library-based method with a descriptive-analytical approach. In this qualitative study, necessary information was gathered by reviewing authoritative domestic and foreign books and sources, relevant laws and regulations, advisory opinions of the Legal Department, and related research articles. Notes were extracted on index cards and analyzed and interpreted through thematic classification.
Findings: The suspension of a lawyer in pending cases has significant legal effects, including disruption of judicial proceedings, violation of the client's right to defense, reduction in the validity of the power of attorney, and the possibility of filing a civil liability lawsuit against the lawyer. This suspension also brings social consequences such as reduced public trust in the legal profession and economic consequences due to the lawyer's loss of income. However, the legal system has provided protective measures such as appointing court-appointed counsel, granting an opportunity to introduce a new lawyer, and the possibility of claiming damages. Furthermore, a suspended lawyer can return to the legal profession after the suspension period ends, the removal of the causes of the violation, and approval by disciplinary authorities.
Conclusion: The suspension of a lawyer aims to protect the legal profession's dignity but directly impacts clients' rights and court proceedings. To ensure fairness, such penalties must balance professional discipline with client protection—achieved in Iran through court-appointed counsel, damage claims, and reinstatement options.
